စစ်အုပ်စုထိန်းချုပ်ထားသော မြန်မာနိုင်ငံအမျိုးသားလူ့အခွင့်အရေးကော်မရှင်အား ဖျက်သိမ်းခြင်း – SAC-M မှ NUG၏ ဆုံးဖြတ်ချက်ကို ကြိုဆိုလိုက်သည်

 မြန်မာဘာသာဖြင့် ထုတ်ပြန်ကြေညာချက်အား အောက်တွင်ဖတ်ရှုနိုင်ပါသည်။

18 February 2025: The Special Advisory Council for Myanmar (SAC-M) welcomes the decision of Myanmar’s legitimate National Unity Government (NUG) to dissolve the junta-controlled Myanmar National Human Rights Commission (MNHRC).

SAC-M urges the NUG to establish a new, impartial and independent National Human Rights Institution (NHRI) to replace the defunct MNHRC without delay.

The MNHRC was formed in 2011 under the quasi-civilian Thein Sein government and has been complicit in the horrific violence committed by the Myanmar military in the years that followed, including since its attempted coup on 1 February 2021.

The NUG’s decision to dissolve the Commission follows a ruling by the Global Alliance of National Human Rights Institutions (GANHRI) on 31 December 2024, to officially revoke the MNHRC’s accreditation status and remove it from its network. GANHRI, which accredits NHRIs worldwide, found that the MNHRC had failed to meet the Paris Principles — minimum standards that NHRIs must meet to be considered credible and effective, adopted by the United Nations General Assembly in 1993. 

In practice, the MNHRC’s main function since its formation has not been to protect the rights of the Myanmar people, but to attempt to whitewash the military’s abhorrent human rights record. The Commission stayed silent during the military’s genocidal attacks against the Rohingya in Rakhine state in 2016 and 2017. The MNHRC has not once raised the alarm as credible allegations of human rights violations and serious international crimes committed against civilians by the junta have become widespread since its attempted coup.

GANHRI’s decision to revoke the MNHRC’s accreditation marks a significant blow to the military’s attempts to launder its enduring international image as one of the world’s worst human rights abusers.

The people-led process already underway to remove the military and build a new Myanmar is, at its heart, a struggle for human rights. The establishment of an impartial, independent NHRI for Myanmar, that upholds the Paris Principles, is a critical step in the development of robust human rights protections for all Myanmar people.

SAC-M calls on the NUG, having sacked the junta-controlled MNHRC leadership, to also sack the criminal leaders of the illegitimate Myanmar military, including Commander-in-Chief Senior General Min Aung Hlaing, and his deputy, General Soe Win and appoint new, legitimate leaders to head the military.

Furthermore, SAC-M calls on the NUG to dissolve the junta-controlled Union Election Commission and establish a new, independent Election Commission in preparation for such time that free, fair, and genuinely democratic elections are held in accordance with the Federal Democracy Charter.

SAC-M သည် NUG အား ပျက်ပြယ်သွားပြီဖြစ်သော MNHRC ကို အစားထိုးရန်အတွက် လူ့အခွင့်အရေးဆိုင်ရာအဖွဲ့အစည်းတခုအဖြစ် တရားမျှတပြီးလွတ်လပ်သော နိုင်ငံလုံးဆိုင်ရာ လူ့အခွင့်အရေးအဖွဲ့အစည်း (NHRI) အသစ်တခုကိုနှောင့်နှေးခြင်းမရှိဘဲဖွဲ့စည်းရန် တိုက်တွန်းပါသည်။

MNHRC ကို ၂၀၁၁ ခုနှစ်တွင် အရပ်သားတပိုင်းအစိုးရဖြစ်သည့် ဦးသိန်းစိန်အစိုးရလက်ထက်တွင် ဖွဲ့စည်းခဲ့ပြီး ၂၀၂၁ ခုနှစ်၊ ဖေဖော်ဝါရီ ၁ ရက်တွင် အာဏာသိမ်းရန်ကြိုးပမ်းမှုအပါအဝင် နောက်ပိုင်းနှစ်များတွင် မြန်မာစစ်တပ်မှကျူးလွန်ခဲ့သော ကြောက်မက်ဖွယ်ကောင်းသော အကြမ်းဖက်မှုများတွင် ပါဝင်ပတ်သက်ခဲ့သည်။

အမျိုးသားညီညွတ်ရေးအစိုးရ (NUG) ၏ မြန်မာနိုင်ငံ အမျိုးသားလူ့အခွင့်အရေးကော်မရှင် (MNHRC) ကို ဖျက်သိမ်းရန် ဆုံးဖြတ်ချက်သည် Global Alliance of National Human Rights Institutions (GANHRI) ၏ ၂၀၂၄ ခုနှစ်၊ ဒီဇင်ဘာလ ၃၁ ရက်နေ့ ဆုံးဖြတ်ချက်အရ ထွက်ပေါ်လာခြင်းဖြစ်ပြီး GANHRI ၏ ဆုံးဖြတ်ချက်မှာ  MNHRC ၏ အသိအမှတ်ပြုအဆင့်အတန်းကို တရားဝင်ရုပ်သိမ်းရန်နှင့် ၎င်း၏ကွန်ရက်မှ ဖယ်ရှားရန် ဖြစ်သည်။ ကမ္ဘာတစ်ဝှမ်းရှိ NHRI များကိုအသိအမှတ်ပြုသည့် GANHRI အနေနှင့် MNHRC သည် ပါရီမူများနှင့်မကိုက်ညီကြောင်း တွေ့ရှိခဲ့သည်၊ ပါရီမူများသည်၁၉၉၃ ခုနှစ်တွင် ကုလသမဂ္ဂအထွေထွေညီလာခံမှ အတည်ပြုခဲ့ပြီး NHRI များအား ယုံကြည်စိတ်ချရပြီး ထိရောက်မှုရှိသည်ဟု သတ်မှတ်ရန်လိုအပ်သော အနည်းဆုံးစံနှုန်းများဖြစ်သည်။

လက်တွေ့တွင် MNHRC ဖွဲ့စည်းပြီးချိန်မှစ၍ ၎င်း၏အဓိကလုပ်ဆောင်ချက်မှာ မြန်မာပြည်သူများ၏ အခွင့်အရေးကို ကာကွယ်ရန်မဟုတ်ဘဲ ဖြစ်ရပ်မှန်များကိုဖုံးကွယ်ခြင်းဖြင့် စစ်တပ်၏ စက်ဆုပ်ဖွယ်ကောင်းသော လူ့အခွင့်အရေးမှတ်တမ်းအား သိက္ခာဆယ်ရန် ကြိုးပမ်းခြင်းပင်ဖြစ်သည်။ ၂၀၁၆ နှင့် ၂၀၁၇ ခုနှစ်များတွင် ရခိုင်ပြည်နယ်ရှိ ရိုဟင်ဂျာများအပေါ်စစ်တပ်၏ လူမျိုးသုဉ်းသတ်ဖြတ်မှုတွင် ၎င်းကော်မရှင်သည် နှုတ်ဆိတ်နေခဲ့သည်။ အာဏာသိမ်းရန် ကြိုးပမ်းပြီးချိန်မှစ၍ အရပ်သားများအပေါ် စစ်အုပ်စု၏ လူ့အခွင့်အရေးချိုးဖောက်မှုများနှင့် ပြင်းထန်သော နိုင်ငံတကာရာဇဝတ်မှုများဆိုင်ရာ စွပ်စွဲချက်များ ကျယ်ကျယ်ပြန့်ပြန့် ထွက်ပေါ်လာသော်လည်း MNHRC သည် တကြိမ်မျှပင် သတိပေးနှိုးဆော်ခြင်း မရှိခဲ့ပေ။

MNHRC ၏အသိအမှတ်ပြုမှုကို ရုပ်သိမ်းရန် GANHRI ၏ ဆုံးဖြတ်ချက်သည် ကမ္ဘာ့အဆိုးရွားဆုံး လူ့အခွင့်အရေးချိုးဖောက်သူများထဲမှ တဦးအဖြစ် စစ်တပ်၏ နိုင်ငံတကာပုံရိပ်ကို ဖြူဖွေးစေလိုသည့် ၄င်း၏ ကြိုးပမ်းမှုများကို ထိခိုက်စေသည့် သိသာထင်ရှားသော ဖြစ်ရပ်တခုဖြစ်သည်။

စစ်တပ်ကို ဖယ်ရှားပြီး မြန်မာနိုင်ငံသစ်တရပ်တည်ဆောက်ရန် လူထုဦးဆောင်သောလုပ်ငန်းစဉ်သည် ခရီးတွင်လျက်ရှိနေပြီး ၎င်းသည် အနှစ်သာရအားဖြင့် လူ့အခွင့်အရေးအတွက် အပတ်တကုတ် ကြိုးပမ်းအားထုတ်မှုတရပ်ပင်ဖြစ်သည်။ ပါရီမူများကို လိုက်နာသော မြန်မာနိုင်ငံအတွက် တရားမျှတပြီး လွတ်လပ်သော နိုင်ငံလုံးဆိုင်ရာလူ့အခွင့်အရေးအဖွဲ့အစည်း(NHRI) တရပ် ထူထောင်ခြင်းသည် မြန်မာပြည်သူအားလုံးအတွက် ခိုင်မာသော လူ့အခွင့်အရေးကာကွယ်မှုများအား ကြီးထွားရင့်သန်စေရေးတွင် အရေးကြီးသောခြေလှမ်းတခုဖြစ်သည်။

SAC-M သည် စစ်အုပ်စုထိန်းချုပ်ထားသော MNHRC ခေါင်းဆောင်များကို ရာထူးမှ ထုတ်ပယ်ပြီးသည့်နောက်တပ်မတော်ကာကွယ်ရေးဦးစီးချုပ် ဗိုလ်ချုပ်မှူးကြီး မင်းအောင်လှိုင်နှင့် ၎င်း၏လက်ထောက် ဗိုလ်ချုပ်မှူးကြီးစိုးဝင်းအပါအဝင် တရားမဝင် မြန်မာစစ်တပ်၏ ရာဇဝတ်သား ခေါင်းဆောင်များကိုလည်း ရာထူးမှထုတ်ပယ်ပြီး စစ်တပ်ကိုဦးဆောင်ဖို့အလို့ငှာ တရားဝင် ခေါင်းဆောင်သစ်များအား ခန့်အပ်ရန် NUG အား တောင်းဆိုပါသည်။

ထို့အပြင် SAC-M သည် စစ်အုပ်စုထိန်းချုပ်ထားသော ပြည်ထောင်စုရွေးကောက်ပွဲကော်မရှင်ကို ဖျက်သိမ်းပြီး ဖက်ဒရယ်ဒီမိုကရေစီပဋိညာဉ်နှင့်အညီ လွတ်လပ်၍ တရားမျှတပြီး စစ်မှန်သော ဒီမိုကရေစီရွေးကောက်ပွဲများ ကျင်းပပေးသော အခါသမယအတွက်ပြင်ဆင်နိုင်စေရန်အလို့ငှာ လွတ်လပ်သော ရွေးကောက်ပွဲကော်မရှင်အသစ်တရပ်အား ထူထောင်ရန်အတွက် NUG အား တောင်းဆိုလိုက်ပါသည်။
